The argument by Apple is that the sales ban should be reinstated because it uses the technology that is being infringed on and competes with Samsung. However the ruling by the three-judge panel found that consumers did not buy Samsung phones primarily because of the patent, and therefore made a sales ban inappropriate.
Precedents on the legal landscape have made it more difficult recently for companies to get court enforceable sales bans related to patent infringement. These sales bans are used by the companies a leverage in courtroom patent fights and can be used to force settlement.
Apple Inc (NASDAQ:AAPL) saw a request for a permanent sale ban rejected this week by US District Judge Lucy Koh against 26 Samsung phone devices that were mostly older. Koh cited the Federal Circuit’s Nexus ruling as binding legal precedent in her order.
Apple has said it intends to appeal Koh’s ruling.
